With our buying power, Webprice.com.au sells at much less than a retail superstore or “genuine” internet stores, therefore it is unlikely that you will find a lower advertised price. If this did occur and the advertised price is within 15 days of our invoice date, we would refund the difference in price providing the competitor’s price is genuine and offered by a recognised and endorsed Australian dealer of the product with stock available for immediate delivery.

Our Best Price Guarantee does not apply (1) if the manufacturer has decreased the price after your goods have been invoiced and dispatched, a situation beyond our control, or (2) to prices that may be advertised by internet sites with a .com.au address that is operated from overseas or internet sites based in Australia “grey-importing” goods from overseas. HOW TO PURCHASE & PAY

Simply add the items you wish to purchase to your “Cart” or “Wish List” and then go to “check-out” to register and complete all the information requested. These details are required for security purposes, not only to protect you but also to ensure that all the information supplied including the delivery address is correct.

When we receive your order we will phone you to confirm all details and provide a delivery date including the exact cost of freight to your preferred delivery address. We will then send to you via email your invoice with all the relevant information. Goods & services ordered will be delivered when the total invoice amount has been paid and clearance of payment by cheque, EFT, or credit card authorisation approved.

Credit Card: We accept Visa, MasterCard, and American Express and unlike most other internet stores we DO NOT charge an extra credit card fee. Please note: We do not charge your credit card until the goods are ready for dispatch. Your Credit Card payment is also totally secure, please refer to the GeoTrust SSL certificate on our Home Page.

Webprice.com.au does not accept non-Australian credit cards but (subject to some conditions) will accept payment from international customers via Electronic Funds Transfer only.

Cheque: When you receive our invoice you can choose to pay by cheque, posted to WEBCLUB PTY LTD, PO Box 61, Abbotsford VIC 3067. The goods you have ordered will be delivered as soon as your Bank has cleared the cheque, please allow up to five (5) days for your cheque to clear.

EFT: If you choose to pay by Electronic Funds Transfer, the details of our Bank Account will be sent to you with our invoice. On receipt of funds your goods will be immediately dispatched to your nominated delivery address.

GREY IMPORTED PRODUCTS

Beware, there are many internet sites advertising products at cheap prices supposedly with international or Australian warranties. These products are imported from overseas sources by the company selling on the Internet and the Australian distributors (e.g. Sony, Panasonic) will not provide warranty support for these products. These “grey imported” products can also be dangerous to use as they do not comply with Australian standards and specifications relating to our 240 volt power supply and electromagnetic and radiation requirements (http://www.acma.gov.au).

If you see a price advertised on the Internet at much less than Webprice.com.au for a camera, projector etc it will more than likely be a grey imported product. Webprice.com.au only sells genuine products imported by the Australian Distributor or Manufacturer complete with a comprehensive Australian warranty.

By visiting and using the Webprice.com.au website, you the (“purchaser”) agree to be bound to and abide by the following terms and conditions.

DISCLAIMER OF LIABILITY

While Webclub Pty Ltd [trading as Webprice.com.au] ensures the optimal performance of the site, you agree that you use this site at your own risk. You acknowledge that Webclub Pty Ltd is not liable for any loss or damage which may be incurred as a result of using this Website or any material presented on or accessed from this Website, including:

- any delays, inaccuracies failures, errors, omissions, interruptions, deletions, defects, viruses, communication line failure or damage to your computer system or network (whether or not they arise as a result of the negligence of Webclub Pty Ltd or its employees or agents) or

- any action or failure to act by any person in accessing, downloading, uploading, using, relying on or dealing in any way with, any materials from the Site.

TERMINATION

Webclub Pty Ltd reserves the right to immediately terminate your use of, or access to this site at any time, if Webclub Pty Ltd decides at its sole discretion that you have breached this agreement or any relevant rule or regulation or you have engaged in conduct that Webclub Pty Ltd considers to be inappropriate or unacceptable.

PRICE FOR GOODS SUPPLIED

The price for goods to be suppled is firm and will be supplied as per the special prices quoted by Webclub Pty Ltd at the time you order.

If a manufacturer decreases the price of the goods you have purchased after we have invoiced and dispatched any items, this situation is beyond our control and Webclub Pty Ltd will not accept any responsibility for this action and will not be required to refund a price decrease if this does occur.

If the manufacturer increases the price of the goods you may have on backorder and we request payment for any price increase, you may cancel the order by contacting Webclub Pty Ltd in writing, which must be received within seven days of us notifying you of the increase.

All prices quoted are inclusive of GST and are subject to change at any time at the sole discretion of Webclub Pty Ltd. In the event that freight &f insurance has not been added to the order from you, this will be charged separately and payment will be due as per the terms specified. Webclub Pty Ltd reserves the right to restrict the supply of goods to individuals or business, government organisations only and is not obligated to supply in commercial quantities.

OWNERSHIP OF GOODS PURCHASED

Ownership of "the goods" delivered by the seller Webclub Pty Ltd to the purchaser is only transferred to the purchaser or any other interested party acting on behalf of the purchaser when all sums owing to Webclub Pty Ltd have been paid in full. In the event that goods have been delivered but payment is not made, the purchaser hereby grants Webclub Pty Ltd the right to enter the purchaser’s premises (or the premises of any associated company or agent where the goods are located) without liability for trespass or any resulting damage and retake possession of the goods and deal with the repossessed goods according to its wishes. In the event of the purchaser claiming possession before ownership, the purchaser is strictly forbidden from transferring, assigning or dealing with the goods in any manner or form. Any conduct to the contrary will result in legal proceedings with Webclub Pty Ltd seeking punitive damages. Risk of loss or damage to the goods shall pass to the purchaser upon delivery of the goods to the purchaser, or upon collection of the goods from the seller or any bailee or agent of the seller by the purchaser’s agent, carrier or courier.

DELIVERY OF GOODS

We deliver to any location in Australia by Australia Post (small items only) or by our carrier StarTrack Express. Deliveries can only be made on weekdays, to Melbourne generally within one working day of dispatch from our warehouse, Sydney & Brisbane within 2-3 working days, country and other interstate areas 3-7 working days.

StarTrack Express must obtain a signature when the goods are delivered. Therefore, it is important that you notify us if you will not be at the address supplied to us for delivery purposes. The purchaser must be available to sign for the goods purchased or nominate a person to sign on the purchasers behalf at the delivery address. If the delivery address is unattended at the time of delivery, or if the purchaser or a nominated person is not available to sign for and accept delivery of the goods, the carrier will not leave the goods and all costs for re-delivery attempts will be charged to the purchaser. Immediate payment to Webclub Pty Ltd will be required before any re-delivery of the goods.

If you would prefer to collect the goods from our warehouse in Melbourne, the address details will be sent to you along with our invoice and when payment has been made.

Supply of goods to the purchaser at the delivery address is always subject to availability. Generally most goods are either available for delivery direct from our warehouse or from the manufacturer/importer’s warehouse. If an item you have ordered is out of stock or unavailable, we will place that item on backorder until it becomes available and notify the purchaser accordingly. The Purchaser must notify Webclub Pty Ltd of its intention to cancel the order within 48 hours of being notified of the backorder. Any delivery period stated on the Website is an indication only of the anticipated period for delivery of the products, and does not form part of the agreement for sale of the products.

Terms & Conditions of Free Delivery: As a special promotion we may occasionally offer FREE DELIVERY for some items and Webclub Pty Ltd reserves the right to determine where and to what address we will provide this service. This limited offer may be restricted to state capital east coast cities and suburbs including South Australia only and may exclude delivery to country areas and Western Australia due to the higher costs of delivery to these areas. We also reserve the right to determine the commencement and finishing dates and times of any free delivery offer that is "live" on our website.

SHIPPING DETAILS & INSURANCE

Webclub Pty Ltd will deliver items to the purchaser’s address anywhere in Australia by way of StarTrack Express or Australia Post. We require a street address for all deliveries of items paid by credit card as we cannot deliver to a PO Box.
A confirmation email will be sent outlining availability and shipping charges.


When your goods are dispatched you will receive an email from us with a tracking number. Simply logon to the StarTrack website, enter your tracking number and you will see the progress of your delivery with an expected delivery day.

Webclub Pty Ltd insures all goods when in transit and the responsibility for insurance against damage or loss by any means including but not exclusively, fire, water damage, or theft will become the sole responsibility of the purchaser once the goods have been signed for and received by the purchaser.

SERVICE AUSTRALIA WIDE

If you require service for any goods purchased through Webclub Pty Ltd either under warranty or out-of warranty, please contact Webclub Pty Ltd or the manufacturer/importer for the location of your nearest service agent in Australia. For large items such as Plasma TV, LCD TV, in-home service may be available in most locations throughout Australia subject to the manufacturer’s terms and conditions (please refer to your warranty card supplied with the goods). It is important that you retain your Webclub Pty Ltd invoice as proof of purchase for under warranty repair.

WARRANTY & SUPPORT

Australian Warranty:
All products sold on our website are brand new (not second-hand, used, or re-packed). All goods are genuine and recognised brand names purchased from the Australian Distributor/Manufacturer and covered by their extensive parts and labour warranty wherever you live in Australia.

Manufacturer’s Warranty:

ALL goods purchased from Webclub Pty Ltd are sold with the manufacturer’s warranty that is applicable at the time of purchase. Webclub Pty Ltd will not accept an extension to the warranty that is expressed or implied and applicable for the specific period of time stated in the manufacturer’s warranty. If goods supplied are found to be defective during the period of the standard manufacturer’s warranty, please utilise the manufacturer’s service and support phone lines or you may contact us for the location and telephone number of your nearest service agent in Australia. If you require Webclub Pty Ltd to arrange the repair on your behalf, you hereby agree to bear all costs of shipping and insurance associated thereof. Webclub Pty Ltd is not responsible for any parcel missing in transit, on its return back to Webclub Pty Ltd.

Extended Warranty
:
An extended warranty for a period additional to the manufacturer’s warranty may be available for purchase at the time of ordering the goods with Webclub Pty Ltd. This could be for an extra 2-4 years (maximum 5 years), depending on the warranty term offered by the manufacturer. An extended warranty will provide ‘peace-of-mind’ and includes a complete parts & labour cover for your important purchase or in some situations if the product cannot be economically repaired it will be replaced at no cost to you.

The Extended Warranty is optional and available at the time of purchase, providing additional protection when your manufacturer’s warranty has expired.

To purchase an Extended Warranty or to enquire about the price and availability of extended warranties for a product, simply indicate your interest when our Customer Service telephones you to confirm details of the order you have placed.

REFUND & EXCHANGE POLICY

There will be no credit given on your order if there is a price difference due to price drops, (please refer also to “Price for Goods Supplied”). Once the goods have been dispatched, there will be no credit or refund for your purchase if you simply “change your mind”, therefore please select carefully at the time when you place your order.

Webclub Pty Ltd reserves the right to refuse to refund or exchange certain goods including but not exclusively limited to: computer software and capture cards, trolleys, brackets, accessories, specially modified items, and any other item that is generally regarded as being protected by copyright provisions.

Webclub Pty Ltd will exchange the goods if the product supplied is dead on arrival, damaged in transit or incorrectly shipped and the claim for exchange must be made within 2 days from the date of delivery. The procedure for claiming a refund or exchange will be as follows:

- If the product you receive is dead on arrival, damaged in transit or incorrectly shipped, you should contact our Customer Service staff immediately and request a Return Goods Authority (RGA) form.

- The RGA form must be completed and signed by you and accompany the returned goods.
- Webclub Pty Ltd will then organise to pick the product up from you at our cost. You will need to retain a copy of the carriers consignment note as proof that the product has been collected from you.

- Webclub Pty Ltd will check any product returned within 7 business days of receipt into our warehouse to ascertain the performance or product damage. In some situations it may be necessary to return the product to the manufacturer or their service agent for checking.

- If Webclub Pty Ltd or the manufacturer determines that the product is defective, Webclub Pty Ltd will supply a new product at no additional cost.

- If you receive a product that is incorrectly shipped i.e. not the product you ordered, we will send you the correct product at no additional cost.

- You will be issued a credit for the original purchase price of the product and any associated freight costs and a new invoice will be issued.

- There may be a situation where you elect to receive a refund, and if Webclub Pty Ltd agrees the refund will be issued by way of how you originally paid for the goods, i.e. cheque, electronic bank transfer or credit card to the value of the refund. Please note Webclub Pty Ltd reserves the right to repair damaged goods or charge for any associated costs prior to offering any refund.

Please Note:
- Returned goods must be in its original condition and complete with all the accessories originally supplied and include all the original packaging. If such conditions are not met, Webclub Pty Ltd reserves the right to charge a restocking fee, which will be deducted from the purchase price or in the case of an exchange, payable by the purchaser pursuant to the payment terms of Webclub Pty Ltd.

- Webclub Pty Ltd will only accept responsibility for payment of the carriers charge if the purchaser returns the goods with the RGA form and by a carrier that has been authorised by Webclub Pty Ltd.

- If you have returned a product because it was dead on arrival or damaged in transit but we find that the product is in full working condition or any defects or damage were caused after you received delivery of the product, Webclub Pty Ltd will be entitled to invoice you for the processing fee and any freight costs associated with the return and these invoiced amounts must be paid before Webclub Pty Ltd will return the goods to you.

- Similarly, if Webclub Pty Ltd finds that we have shipped the correct product i.e. where you have ordered the incorrect product by mistake, you will be invoiced a processing fee and any freight costs associated with the return. These invoiced amounts must be paid immediately before Webclub Pty Ltd will deal with exchanging the product.

- If the product you have received develops a fault within 14 days of the invoice date, it may be possible (at our discretion) to return it to Webclub Pty Ltd, (or) the manufacturer or their service agent. Please contact our Customer Service staff immediately should this unlikely situation occur. Please note however the product will be covered by the manufacturer's warranty or our Extended Warranty (if you have purchased one) and a decision will be made at the time to satisfactorily deal with this situation.

- All faulty products with an invoice date of more than 14 days will be treated as a manufacturer’s warranty claim therefore the terms and conditions detailed in their warranty certificate that you have received with the goods supplied will apply.

At Webclub Pty Ltd we respect your privacy. We have never and will not disclose your personal information to any third parties unless we are required to do so by law. These details are only kept for the purposes of providing you with the service you require or with information relating to our products and services that may be of interest to you, unless you have previously advised us that you do not wish to be contacted for this purpose. All details are kept on a secure PC with limited access. If you wish to have your details removed from our database, please contact Webclub Pty Ltd in writing or by email. However, if there are overdue monies owing to Webclub Pty Ltd for the supply of goods and services, all personal information kept by Webclub Pty Ltd, including your name & address, may be disclosed to a debt collection agency or other parties for the purpose of recovering from you the overdue monies and any costs that may be associated with this action. These terms and conditions shall be construed in accordance with the laws of the State of Victoria, and the parties shall submit to the Courts of that jurisdiction.
